Your rights and responsibilities when using tclock.pro

These Terms constitute a legally binding agreement between you and EZcontractPRO LLC ("Company," "we," "us," or "our"). You must be at least 18 years old to use this Service.
Important: By creating an account or using tclock.pro, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
tclock.pro is a GPS-verified time tracking platform designed for contractors, field service businesses, and teams. Our Service enables you to:
tclock.pro is available as a web application and as native mobile applications for iOS and Android ("tclock pro" and "tclock pro kiosk"). We continuously improve our Service and may add, modify, or remove features at any time. Material changes will be communicated to active subscribers.
To use tclock.pro, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

We are not liable for any loss or damage arising from unauthorized use of your account.
As an employer or administrator, you are responsible for managing employee accounts created under your subscription. You must ensure that employees are aware of and consent to GPS location tracking and time recording when using the Service.
We offer a 30-day free trial with full access to features. No credit card is required to start your trial. At the end of the trial, you may subscribe to continue using the Service.
We offer multiple subscription tiers (Starter, Growth, Business, Enterprise) with different feature sets. Current pricing and features are available on our website. Subscriptions are billed monthly or annually based on your selection.
Payments are processed securely through Stripe. We do not store your full credit card information on our servers. By subscribing, you authorize us to charge your payment method on a recurring basis.
Monthly subscriptions may be cancelled at any time. We do not provide prorated refunds for partial months. Annual subscriptions may be eligible for a prorated refund within 30 days of purchase if you are unsatisfied with the Service.
We may change subscription prices with 30 days notice. Price changes will apply to your next billing cycle after the notice period.
You own your data. All employee time records, GPS location data, project information, and other content you create or upload remains your property. We do not claim any ownership rights to your data.
Your data is stored on secure servers in the United States. We maintain regular backups to protect against data loss.
You may export your data at any time through the Service, including CSV exports of time records and reports. Upon account termination, you may request a data export within 30 days.
We retain your data for the duration of your subscription plus 90 days after cancellation to allow for reactivation. After this period, data may be permanently deleted. Archived or deleted items within your account follow your chosen retention settings.
tclock.pro is available as native mobile applications distributed through the Apple App Store and Google Play Store:
The tclock pro app collects GPS location data at the time of clock-in and clock-out events to verify employee presence at designated job sites. By using the mobile application, employees consent to this location data collection during clock events. Location data is collected only during active clock-in and clock-out actions and is not continuously tracked in the background.
The mobile applications may send push notifications related to clock reminders, overtime alerts, and other time tracking events. You can manage notification preferences through your device settings at any time.
Your use of the mobile applications is also subject to the terms and conditions of the Apple App Store or Google Play Store from which you downloaded the app. In the event of a conflict between these Terms and any app store terms, these Terms shall govern your use of the Service to the extent permitted.
Subscription management and billing are handled through our website. The mobile applications do not offer in-app purchases or subscriptions through the Apple App Store or Google Play Store.

The tclock.pro name, logo, software, website design, mobile applications, and all related materials are the property of EZcontractPRO LLC and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, or create derivative works of our Service without written permission.
Your content (time records, employee data, reports) remains your property. By using the Service, you grant us a limited license to store, display, and transmit your content solely to provide the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
tclock.pro is a time tracking tool and does not provide legal, tax, or financial advice. You are responsible for ensuring your time tracking and labor practices comply with applicable laws and regulations, including wage and hour laws.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZCONTRACTPRO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow limitations on implied warranties or liability, so the above limitations may not apply to you.
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period.
